Many critics attribute the use of “false flags” to pirates, who would fly the flag of an intended ship until they were close enough to attack, at which point they would put up the skull and crossbones, too late for the ship being targeted to flee.
But the story of the “false flag” is deeper and more widespread. Under maritime law, it was completely acceptable for one ship to fly a “false flag” to pursue an enemy ship or attempt to flee. However, “it is generally accepted that shortly before a strike a ship must fly her national flag,” according to a 1914 law journal article.
